ESA Joins Cross-Industry Letter Supporting Trans-Atlantic Data Privacy Framework

On April 26, ESA joined 23 associations in a letter demonstrating support for an agreement-in-principle between the United States and the European Commission to reestablish the Privacy Shield program, which will facilitate trans-Atlantic data transfers and improve protections for individual privacy and civil liberties.

The United States and the European Commission announced on March 25 their plan to adopt a new Framework to address the concerns raised in 2020 by the European Court of Justice when it struck down the Commission’s adequacy decision underlying the EU-U.S. Privacy Shield framework.

In the coming weeks, the White House is expected to issue a related Executive Order followed by DOJ-issued regulations.  An adequacy determination from the EU is anticipated in several months, paving the way for final approval of the Framework.  The White House Fact Sheet is available here.
