2025 International Intellectual Property Alliance Special 301 Report Submission

On January 27, 2025, the International Intellectual Property Alliance (IIPA) filed its annual Special 301 Report submission with the Office of the United States Trade Representative (USTR). The Entertainment Software Association (ESA) contributes to this submission with details on intellectual property (IP) protection and enforcement in foreign markets around the globe. This year’s filing highlights noteworthy achievements, such as the leadership shown by Brazilian enforcement agencies engaged in Operation 404 actions, and remaining challenges in combatting online piracy of video games. 

Strong IP laws and enforcement mechanisms are fundamental for U.S. video game publishers to provide entertaining products worldwide. The annual Special 301 review process examines the adequacy and effectiveness of these IP regimes, and remains a key tool for U.S. rights holders. Released in April, the USTR report identifies countries that do not provide sufficient intellectual property protections or provide fair and equitable market access to U.S. persons who depend on intellectual property rights.
